“Campagna ideale senza controindicazioni.”

- Abduction of Maksharip Aushev’s relatives in St.Petersburg. New facts

On December 26, 2010 at night several residents of Ingushetia disappeared in St.Petersburg. They were relatives of Fatima Janieva, the widow of famous public figure – Maksharip Aushev (see HRC "Memorial" press-statement: http://www.memo.ru/2009/12/29/2912094.htm).

The disappeared were Usup Dobriev, DOB 1968, Unus Dobriev, DOB 1971, Ali Janiev, DOB 1992 and Magomed Adjiev, DOB 1989.

On December 16, 2009, a car with Fatima Janieva, her mother Leila Janieva and two brothers – Amirhan, DOB 1988 and Muslim, DOB 1984, was blew up in Nazran. As a result Fatima’s mother and two brothers were killed. Fatima, heavily wounded and pregnant, moved to St.Petersburg with her brother Ali.

On December 25, in St.Petersburg in the evening Usup and Unus Dobrievs, Ali Janiev and Magomed Adjiev went to their relatives by car, who lives in the city. In an hour after their leave their cell phones became unavailable.

On December 26, in the morning the relatives of the abducted applied to the police department № 30 of Vasileostrovsky district of St.Petersburg. The application of Tanzila Dobrieva, Unus Dobriev’s wife, was accepted only after long persuasions. The application was redirected to the police department № 86 of Primorsky district. It was not considered for two weeks. Only on January 9 Tanzila Dobrieva met the district police officer of Primorsky district police department.

The criminal case on point "a" part 2 article 105 of Russian Criminal code (killing of two or more people) was initiated only on December 25, despite the fact that the time for considering the application is three days. The criminal case is in process in the committee of inquiry at public prosecutor’s office in St.Petersburg.

Unfortunately, the investigation didn’t ask for the CCTV recordings of the place of the supposed abduction. At the end of February the recordings of all cameras were destroyed due to the period of limitation.

The recordings at the crossroads of the city monitor center were taken only by the demand of Tanzila Dobrieva. The victims managed to describe the place and time of supposed abduction. It is clearly seen on the recordings that Dobriev’s car was pursued by two white minivans breaking road regulations. Also there was a car which looked like the one that kept the relatives of the abducted under surveillance the next day.

At the beginning of February the car of the abducted was found not far from the supposed place of crime. It was standing in the place which is not covered by the CCTV cameras; there was a dent in the car.

Haven’t seen the results of the official investigation the victims and their relatives held their own investigation. In March they went round the flats which look at the supposed place of crime together with the representatives of HRC "Memorial". Consequently, they managed to find four witnesses. They told in details that the special police operation on the arrest of passengers of the car of the same brand that belonged to the abducted took place at night on December 25-26. The participants of the operation were armed, in masks and in black uniform without service decorations.

According to witnesses black jeep cut in front of the car of the abducted (the dent must have appeared as a result of this maneuver) and blocked the road. Men in uniform went out of the two white minivans and pinioned the passengers’ arms, the one was put on the hood and put handcuffs, another was beaten up. After that they were put in different cars and taken away. The operation continued several minutes. One of the participants made video recordings, another one directed the traffic.

All the witnesses say that the operation looked like accurate, well-coordinated, professional arrest by force operation made by law-enforcement authorities.

The relatives of the victims plan to apply to the European Court of Human Rights.

For more information you can address HRC "Memorial" representative Ekaterina Sokiryanskaya (+7-911-011-3069) and the victims’ lawyers – Olga Ceitlina (+7-921-966-1561) and Ivan Pavlov(+7-812-963-6511).
