After existing for several years as an informal association, the French-Serbian Chamber of Commerce was formalised upon the initiative of presidents Tadic and Sarkozy earlier this year. The Court Proceedings for the Attack on Nalchik: Status of Those on Trial
During the attack on Nalchik (Kabardino-Balkaria Republic), on October 13, 2005, 35 members of law enforcement agencies and military, 14 civilians, as well as 92 of the attackers were killed. A criminal case was initiated for this attack involving 58 people (at first there were 59; however, one of those on trial Valera Bolov, died due to cirrhosis of the liver). They are being charged with Criminal Code articles 105 (Murder), 205 (Terrorism), 209 (Banditry), 210 (Organization of a Criminal Community (Criminal Organization) or participation in it), 222 (Illegal Acquisition, Transfer, Sale, Storage, Transportation, or Bearing of Firearms, its Basic Parts, Ammunition, Explosives, and Explosive Devices), 317 (Encroachment on the Life of an Officer of a Law enforcement Agency) and others. The prosecutor’s version is that all of the crimes were directed toward the constitutional government of Russia and for the secession of Kabardino-Balkaria (KBR) from the Russian Federation in order to create a separate government on the territory of KBR. The accused are not pleading guilty to the charges. Only a few are confessing to “illegal acquisition and storage of firearms.”
Chaired by Mukhamed Tashuev, the Supreme Court of KBR began the trial in November 2007, and after an entire year at the Court, they were still unsuccessfully attempting to strike a jury. Then in January 2009, legislation went into effect eliminating trials by jury for cases involving terrorism (the legislation has been appealed at the Constitutional Court of the Russian Federation, but a decision on the complaint has yet to be made).
In March 2009, the case began to be looked into by three judges chaired by a judge from the KBR Supreme Court, Galina Gorislavskaya.
As of December 11, 2009, almost three episodes of the attack had been looked into (in its entirety, there are more than 10 episodes). Ten witnesses and victims have been questioned, and they have just confirmed the very facts of the events of October 13. During this period, some of those questioned have demonstrated that since 1999 the authorities had been persecuting individuals who professed the Islamic faith: they were placing individuals on the current records with the wording “as an individual, who professes radical Islam or Wahhabism” or just for their religious affiliation. In regards to these individuals, facts have been recorded demonstrating mass violation of human rights—such as the illegal detentions, tortures, abductions, and murders. Some of the prosecution’s witnesses have demonstrated that officers of the law-enforcement agencies had used violence toward those detained.
By decree from the President of Russia on December 2, 2009, Galina Gorislavskaya was appointed to a judge’s position on the Moscow Oblast Court. This means that the case’s proceedings will start anew, possibly, in a different region.
At the time of the inquiry and in court, a question had been pointedly raised about the failure to render qualified medical assistance to those on trial, a few of whom were gravely sick. Markedly, the accused Valera Bolov died due to the failure to offer medical assistance. Bolov had chronic hepatitis which at the time of the conclusion, developed into cirrhosis of the liver. HRC Memorial’s Appeal Will be Examined in the Following Year
The examination of the appeal in the civil case Ramzan Kadyrov v. HRC Memorial and Oleg Orlov has been set for January 12, 2010 at 10:30 a.m.
The defendants’ representatives lodged the full appeal on November 16, 2009 (see the entire text of the appeal (in Russian) on Memorial’s web-site: http://www.memo.ru/2009/11/18/1811091.pdf).
On December 8, Memorial received a notice about the examination of the appeal to which the appeal by the plaintiff, lodged on November 9, had been attached (see the whole text of the plaintiff’s appeal on Memorial’s web-site: http://www.memo.ru/2009/12/18/cass.pdf).
Both appeals will be looked into at the session on January 12 in the Moscow City Court. The address of the court is Bogorodsky Val, 8, Moscow, and the examination will take place in hall 348.
