The Date of the First Interrogation of Orlov Changed
The fisrt interrogation of Oleg Orlov in the defamation case is postponed because of the illness of advocate Henry Reznik. The interrogation will take place on 12 or 13 November.

New Court Sessions in the Case of Farid Babayev’s Murder
Tomorrow, on November 10 2009, another session in the case of the murder of Farid Babayev – head of Dagestan regional department of "Yabloko" party, human rights activist and public figure – will take place.
The court sessions have recommenced this summer. On June 4, 2009 the panel of judges of criminal cases of the Russian Supreme Court examined the appeal of the public prosecutor and the respective appeal of defendants. The verdict of the jury and the sentence of the Supreme Court of Dagestan have been annulled. The materials of the case were returned to be examined by another jury.
Farid Babyev was killed on November 21, 2007 in Makhachkala (Dagestan). The first court session took place in October 2008. Rasil Mamedrizayev and Sifirali Sefirmirzayev were the accused. Investigators said these two men were the ones who executed the crime. On January 22, 2009 the Supreme Court of Dagestan sentenced Mamedrizayev to 16 years of strict regime colony. At the same time another accused – Sefirmirzayev – was totally discharged. However, the public prosecutor has already appealed a part of the decision related to the discharge of Sefirmirzayev.
Now the jury assists court sessions. The latest one took place on October 27. The witnesses for prosecution are being heard. The prosecution now has to take to the court a secret witness, whose statement is the only proof of the guilt of the accused.
Two other secret witnesses were heard. They are the women who confirmed that not long before the murder of Babayev they had seen a man resembling the accused in Babayev’s court. One of the witnesses said that she had noticed the young man because he had stood in the court for a long time and talked on phone. The woman took her child to a children garden, and when she returned the young man had still been talking y phone. The second witness just saw the young man but didn’t notice what he was doing. According to the evidences a Photofit picture was composed. The picture very much resembles the appearance of Mamedrizayev.
The advocates of the accused asked to reveal the name of the “secret” witness. Their argument is that everyone already knows this witness. After all the participants of the process had been heard the examination of the appeal was delayed: it is necessary to find out the opinion of the secret witness because it is determinative.
Another session was set on November 5. The main witness was to be interrogated at the session.
Since he didn’t come, another session was set on November 10.

NATO PA delegation visit to Moldova highlights the country’s new ambitions but also serious challenges ahead
A delegation of the NATO Parliamentary Assembly (NATO PA), led by Marc Angel (Luxembourg), Special Rapporteur on Moldova for the Committee on the Civil Dimension of Security, travelled to the Republic of Moldova on 2-4 November 2009. The NATO parliamentarians met representatives of the new quadripartite coalition formed following the 29 July parliamentary elections – the Alliance for European Integration – who presented their ambitious reform agenda, and underlined their desire to give the country and its citizens a “second chance.” The new government’s priorities include promoting European integration and the approximation of Moldova’s legal framework to European standards; consolidating the rule of law; and countering the effects of the financial and economic crisis on the country’s economy.
According to Mr. Angel, “this ambitious reform programme is welcome. The visit of our delegation comes at a decisive moment for the Republic of Moldova. The NATO Parliamentary Assembly has a useful role to play in helping the Moldovan Parliament strengthen the democratic control of the defence and security sector.” On the question of Moldova-NATO relations, Mr. Angel insisted on the fact that “the current framework – the Individual Partnership Action Plan and the other instruments of the Partnership for Peace – offers plenty of room for developing further the co-operation between the Republic of Moldova and NATO. It is important to better inform the Moldovan population about NATO, about the Alliance ’s transformation since the end of the Cold War, as well as about the benefits of the NATO-Moldova partnership.”
Nonetheless, the visit also underlined the serious challenges that Moldova continues to face. After two consecutive parliamentary elections in the spring and summer of 2009, the political situation is not yet completely stabilised. On 10 November a new vote on the election of the President of the Republic will take place in Parliament. Should the election fail, another round of parliamentary elections could be necessary. This vote thus represents an important test of the ability of the country’s political factions to overcome their differences and reach the necessary three-fifths majority required for the election of the new President. The new coalition government will also have to demonstrate that it is able to maintain unity throughout its mandate.
The unresolved conflict over Transnistria is certainly Moldova ’s most complex challenge. Negotiations in the “5+2” format (Moldova, Transnistria, Russia, Ukraine, OSCE, plus the United States and the European Union) have been suspended for almost three years. On 6 November, all the participants will gather in Vienna for a meeting organised by the Greek Presidency of the OSCE. In the meetings they held in Chisinau and Tiraspol, NATO PA delegates heard however that no dramatic outcome should be expected from the Vienna meeting. There are profound differences between the parties on certain key questions pertaining to the resolution of the conflict, especially on a possible evolution of the peacekeeping format.
The Committee on the Civil Dimension of Security will discuss Mr Angel’s report “The Republic of Moldova: Internal Challenges; Prospects for Euro-Atlantic Integration” at the Annual Assembly in Edinburgh on the 14 – 17 November 2009.

The Albanian Foreign Minister, Mr. Ilir Meta, will visit NATO Headquarters on Tuesday 10 November 2009 . He will meet with the Secretary General, Mr. Anders Fogh Rasmussen.

OSCE Office in Baku launches training courses for judge candidates
BAKU, 9 November 2009 - The OSCE Office in Baku launched a project comprising training courses for judge candidates today to support the judiciary’s professional development and to develop curricula for a newly-established Justice Academy.
The project is supported by the Judicial Legal Council, which prepared a four-month training programme, and Azerbaijan’s Justice Academy, which will host the courses. The programme covers topics related to human rights, criminal law and civil law, with a special emphasis on the role of the judge in leading a fair trial.
"Professional legal training is crucial to establish a modern and efficient judiciary," said Ambassador Bilge Cankorel, the Head of the OSCE Office in Baku. "Comprehensive initial training for judges is particularly important to achieve an even greater impact in terms of capacity-building of the judiciary."
The courses target 80 judge candidates who passed two rounds of written examinations and an oral exam.
The training sessions combine lectures and practical exercises. Participants will discuss practical cases to learn how to make motivated decisions based on current legislation. Legal experts from the OSCE Office and international and national experts will teach the course.

GEORGIA PLANS TO OPEN 4 NEW EMBASSIES NEXT YEAR
Finance Ministry Kakha Baindurashvili has declared at the plenary session of the Parliament today that the budget-2010 envisages opening of 4 new embassies.
One of them, to be opened in Brazil, will become the first Georgian diplomatic representation in Latin America.
PUBLIC OFFICIALS’ SALARIES TO BE LIMITED
As Finance Minister Kakha Baindurashvili has declared at the plenary session of the Parliament today, remuneration is upper-bounded for members of regulating commissions.
Namely, according to the draft budget-2010, remuneration should not exceed 10,000 lari for commission chairman, while 5,000 lari – for commission member.

LAYING OF MTKVARIHES’ FOUNDATION STONE TO BE HELD TOMORROW
As executive director of JSC Caucasus Energy&Infrastructure Archil Mamatelashvili has told Sarke, solemn ceremony of MtkvariHES construction starting will be held tomorrow. The matter concerns construction of hydroelectric plant with capacity of 42 MW on Mtkvari River in Samtskhe-Javakheti region, 10 km far from Akhaltsikhe.
SAKARTVELOS BANKI CONTINUES REDUCING INTEREST RATES
As director general of Sakartvelos Banki (Bank of Georgia) Irakli Gilauri declared today, the bank is going to lower on November 16 interest rates for mortgage loans, consumer loans and auto loans almost to their pre-crisis level.
Thus, interest rate on mortgage loans will be decreased from 16% to 14.5% (it was 14% before crisis).
TBILAVIAMSHENI PLANS TO START BATCH PRODUCTION OF VIP-AIRPLANE IN 2010
Kakha Zhgenti, deputy chairman of supervisory council of JSC Tbilaviamsheni (Tbilisi aviation plant), has declared to Sarke that the company plans to launch batch production of 7-seat airplane of VIP-class in 2010. The mentioned airplane with expected market price of about $2 million will be sold mainly on Georgian and CIS markets.

The bankruptcy manager of JSC TbilGRES, David Chachkhiani announced an auction on property of the company. Starting price of the property, auctioned in single lot, amounts to 321.75 millions lari.
GLOBAL ERTY ACQUIRED ONE MORE LICENSE OF RADIOFREQUENCY RANGE USE IN TBILISI
National Communication Commission reports that Global Erty has acquired license on radiofrequency range use in Tbilisi on the auction, held today.
The company bought the license for 6,299 lari, against starting price of 5,932 lari.
REGULATION COMMISSION FINED COMMUNICATIONS CONSULTATION GROUP AGAIN
National Communication Commission reported that LLC Communications Consultation Group has been fined for the second time due to unpaid regulation fee. The fine amounts to 30,000 lari at this time.
IOLI CLOSED DOWN SMALL STORES
Ilia Kantaria, director general of Ioli company, told Sarke that the company shut down 3 small stores 1.5 months ago due to their unprofitability. At this stage, the company focuses on opening large chain stores.
AFRO STAR AND BUKET ARE AUCTIONED FOR THE SAME PRICE
Dry cargo ship Afro Star and tanker Buket, seized by Georgia, are re-auctioned. The starting price was not altered and is defined by 750,000 lari and 1.085 million lari, respectively.
