SPECIAL FEATURING * “Un sogno nel cassetto” (Italy)

- Marco Oletti

Forse.

- Murder of Maksharip Aushev

On October 25th, 2009, around 9.40 am, in Kabardino-Balkaria, on the "Kavkaz" federal highway, close to the village of Nartan Chegemski, an unknown killed an Ingush public figure - leader of the local opposition and a member of the Expert Council of the Commissioner for Human Rights of Russia, Maksharip Magomedovich Aushev.

On the day of the incident, Maksharip Aushev was travelling to Nalchik (KBR) in his "Lada-Priora" car. Together with him in the car was his cousin, Tanzila Dzeytova (Zeytova). Near Nartan, Ausheva’s car was fired at from a passing VAZ-2112 car. According to investigators, it was fired at with an 7.62 calibre AK-74(most probably from two such guns). According to some reports, Aushev’s car was sprayed with more than 40 bullets. Amongst the victims was Aushev himself, who died at the scene, and a woman who was taken to hospital in a serious condition, where she had to undergo several operations. Her condition remains serious.

In fact the murder instituted a criminal case under two articles of the Russian Federation’s Criminal Code - 105 (murder) and 222 (trafficking of weapons). Russia’s Prosecutor General Yuri Chaika put the investigation under his personal control. On his orders, the Deputy Attorney General for the Southern Federal District, Ivan Sydoruk, visited the scene of the crime. The Prosecutor General of the Russian Federation also instructed his First Deputy - Chairman of the Investigation Committee of the Prosecutor of the Russian Federation, Alexander Bastrykin - to send a team of investigators from the Central Investigation Department (CKP) of the Russian Federation in the Southern Federal District to look into the the case.

On the same day, the victim’s body was taken to Ingushetia. The President of the Republic of Ingushetia, Yunus-bek Yevkurov, visited Maksharip Aushev’s parents who live in the town of Nazran, and expressed his condolences. In an official statement the President stated that, "this heinous crime was intended to destabilize the situation in the Republic" (http://www.ingushetia.ru/m-news/archives/012055.shtml#more ). Yevkurov promised to use all the powers and resources at his disposal to solve the crime.

On October 26th, Maksharip Aushev was buried in his ancestral graveyard in the village of Surkhakhi, in the Nazran district of Ingushetia. Large swathes of people attended Aushev’s funeral.

On September 19th, 2007, members of an unidentified uniformed security group kidnapped Maksharip Aushev’s son and his nephew in Grozny, in the Chechen Republic. On the same day, Aushev organized a protest rally in Nazran, which demanded the immediate release of the abductees. On the night of September 20, the two abductees were released (http://www.memo.ru/hr/hotpoints/caucas1/msg/2007/09/m102356.htm).

Aushev personally attempted to investigate the abduction of his son and nephew. He found out that the kidnapped had been kept in a secret prison in the village of Goyty, in the Urus Martan district of Chechnya.

Since that time, Aushev has led the Ingush opposition. Together with his colleagues, he blamed the legal chaos in Ingushetia on the leadership of the Republic. The opposition made several attempts to conduct protests in Ingushetia – however, every time they were brutally suppressed by the Republic’s security forces. The anti-Zyazikov opposition denounced the criminal nature of the then Ingush leadership. Many observers note that it was the decisive actions of the Ingush opposition that led to the resignation of President Zyazikov.

In February 2008, Maksharip Aushev himself was abducted in the village of Ekazhevo, on the outskirts of Nazran district of the Republic of Ingushetia, in the so-called "ekazhevsk circle". Aushev was taken to the detention facility in Nalchik, in the Republic of Kabardino-Balkar. He was charged with organising an illegalf meeting on January 26, 2008 and labelled within the area of counter-terrorist operations. Likewise, he was charged with organising mass unrest that led to the burning down of the offices of the "Serdalo" newspaper in the "Assa" Hotel (http://www.memo.ru/hr / hotpoints/caucas1/msg/2008/02/m120109.htm) .

In June 2008, Aushev was released with a written agreement that he would not leave the region. Charges against him were not withdrawn. In January 2009, the case, which was led by the Central Investigation Department (CKP) of the Russian Federation’s Southern Federal District, was closed. In February, his case was put before a court, with the intent of judging the merits of the charges brought against him. On July 30, 2009 the Supreme Court of the Republic of Ingushetia fully acquited Maksharip Aushev (http://vs.ing.sudrf.ru/modules.php?name=press\_dep&op=1&did=98).

On September 15th, 2009 members of an unidentified uniformed security group once again tried to kidnap Aushev. This time round it took place in the town of Magas, in the Republic of Ingushetia. Aushev managed to avoid being kidnapped by attracting the attention of people passing by the place where he had been stopped by the "security officers" (http://www.memo.ru/hr/hotpoints/caucas1/msg/2009/09/m178071.htm ).

- Another extrajudicial execution in Dagestan

On October 29th, 2009 at approximately 3:00 pm in Makhackala (Dagestan) Murad Salikhov (born in 1985, local resident) was abducted. Some time later he was killed.

According to his wife, Zara Kadimagomedova, Murad was working as a cab driver on October 29th, dropping some clients off near Kazekova St. He then called a friend and told him that he just received another call and drove off to pick up the new passengers in the village of Toube. Suddenly, Murad yelled into the phone: “I’m being abducted!” “By whom? Operatives? The Police?” - his friend asked. “Yes!” - Murad only managed to say. The phone call was lost. Soon after that Murad’s friend went to the home of the abducted man’s mother and described the recent events.

After the relatives have received news of the abduction, they set off for district police department of Makhachkala. However, the officers refused even to take their complaint. The same thing occurred at the Soviet district police department, where they were told that it was the government prosecutor’s job to deal with such questions. But at the prosecutor’s office the complaint was also refused, due to the late hour. On the next day, Murad’s relatives were able to convince the on-duty officers at the municipal prosecutor’s office to accept the announcement.

Murad Salikhov was a follower of the Salafi movement of the Muslim faith; however, in order to not be accused of extremism he strove to live openly. His brother, Magomed Salikhov, took part in armed resistance and was killed in 2004. A little earlier the brothers’ father, Abdulmuslim Salikhov, was killed by a shot to the head while he was on his taxi route. According to relatives, unlike his sons, Abdulmuslim Salikhov did not practice a religion. The relatives believe that Abdulmuslim was murdered in retaliation for the actions of one of his sons, who at the time was “in the forest”.

October 30th Zara Kadimagomedova turned to the Human Rights Center “Memorial” and the committee “Civic Assistance”. She asked for help in finding the abducted.

The next day, October 31st , a member of the Board of HRC “Memorial” and the director of the committee “Civic Assistance”, Svetlana Gannushkina, faxed a request to the prosecutor of Dagestan. On-duty prosecutor Alilov answered that they had news of an automobile explosion, in which four armed persons were killed. Part of the license plate – 026 – could have conceivably matched the plate numbers of Murad Salikhov’s car, and the driver had power of attorney.

That verynight Murad Salikhov’s uncle called one of the members of HRC “Memorial”. He said that he had identified the body of his nephew in the morgue. He then also added that a car with Murad’s body and the bodies of three other people had been found in the Karabudakhkent district.
